What is an Executor?
An Executor is the person(s) who must make sure that the deceased's wishes are carried out exactly as stated in the Will. The duties and powers
do not begin until the person has died. The Executor is also responsible for meeting all the legal and financial requirements of settling
an estate and managing the assets until they are distributed.
Can a Notary Public advise me on what an Executor does and how to go about choosing one?
Yes, a BC Notary Public can be a good source of information on the role of the Executor when you Make a Will.
Some of the Executor's responsibilities are:
determining, locating and notifying family and beneficiaries of your death
arranging for burial or cremation and a funeral service
applying for life insurance benefits
preparing an inventory of your estate's assets and debts
arranging for payment of all debts
filing an income tax return for the year of death and returns for your estate
applying for Letters Probate from the courts, where required
administering testamentary trusts
distributing estate assets
You should consider the following questions when choosing an Executor and an alternate Executor:
Are you confident that the person you are considering will be available during the time needed,
taking time off of work and able to commit that time and energy until the estate is completely settled?
Does the person live in British Columbia?
There are often complications if the Executor is from out of province, particularly if out of country.
Is the person you are considering experienced in dealing with the legal, tax, investment, real estate,
asset valuation, insurance and business management aspects of estate settlement?
Are you aware that the person you are considering can be personally liable if their action or judgment is challenged?
Can the person you are considering remain impartial and able to work well with the beneficiaries?
Is the person you are considering free of any conflicts of interest?
Is the person you are considering someone other than the guardian of your minor children?
Have you advised her/him of the location and contents of your will and has she or her agreed to take on the responsibility?
Some people decide it is best to hire a professional who is impartial and who is experienced in estate matters. The estate will be done
quickly, effectively and the beneficiaries will appreciate not having the added stress of estate management at the time of loss.
A professional as a co-Executor with a family member is one more option for Executor choices.

Assets
It is not necessary to list all of your assets in the Will when you make a Will. These can change and would result in unnecessary visits and expense
with your BC Notary. The Will typically says "all of my property, whatever it is and wherever it may be".
